Please read these Terms of Use carefully before using the http://www.perinaga.com (the "Site") website operated by Perinaga Cemerlang Sdn. Bhd ("us", "we", or "our") . Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service. By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Site and the Service. 

By using the services that we provide, you have agreed to abide by the laws, regulations, policies, guidelines, rules and requirements (whether or not having the force of law) in the relevant jurisdiction governing Perinaga Cemerlang Sdn Bhd and/or the User (as may be applicable), including but without limitation to Anti-Money Laundering, Anti-Terrorism Financing and Proceeds of Unlawful Activities Act 2001, Money Services Business Act 2011, Personal Data Protection Act 2010 and shall include such other requirements that we stipulates from time to time which we term as “Applicable Laws”.

Service
If you wish to purchase any product or service made available through the Service ("Online Request"), you may be asked to supply certain information relevant to your Online Booking including, without limitation, your name, IC number, telephone number, email address and gender. 

Eligibility

1) An individual User must be at minimum 18 years of age and permitted under the Applicable Laws to enter into legally binding agreement.

 

2) User must meet Customer Due Diligence requirements imposed by Perinaga Cemerlang Sdn Bhd and Applicable Laws.

 

3) A Visitor who accesses the Website or avail the Services acknowledges that he may be violating the Applicable Laws and agrees to be solely and absolutely liable for any liabilities arising therefrom and undertakes to indemnify us against any Loss incurred by our pursuant thereto.

 

Prohibitions and Restrictions

User CANNOT :

 

a) Use the Services in any way which will deprive other User(s) of their legitimate right to use the Services. 

b) Use the Website for unlawful purposes in any jurisdiction or in breach of these Terms.

c) Use the Services for any unlawful or illegal activity or in breach of any Applicable Laws.

d) Modify, copy, distribute, reproduce, transmit, display, perform, publish, upload, post, license, create derivative works from, transfer or sell any information, designs, logos, trademarks, software or services obtained from the Website.

e) Post or transmit any unlawful, fraudulent, libelous, defamatory, obscene, pornographic, profane, threatening, abusive, hateful, offensive, or otherwise objectionable information or statement of any kind without limitation, any information or statement constituting or encouraging conduct that would tantamount to criminal offence, give rise to civil liability and/or violates any Applicable Laws.

f) Post or transmit any messages that amount to advertising material, touting or sale of, or offer to sell, any product or service.

g) Transmit or disseminate advertising material, chain letters, spam, junk mail or other type of unsolicited messages.

h) Post or transmit or disseminate viruses, worms, Trojan horses or other harmful, disruptive or destructive files.

i) Post, publish, transmit, reproduce, distribute, or in any way exploit any information, software or other material obtained from or through the Website for commercial purposes.

j) Attempt to decompile or reverse engineer any software available in the Website.

k) Attempt to hack into the Website or otherwise attempt to subvert any firewall or other security measure of the Website.

In the event the Website contains bulletin boards, chat rooms, access to mailing lists or other communication facilities, you are only to send and receive messages that are proper and related to the particular subject forum/purposes only.

 

Any software provided on, by or through the Website for a specific purpose shall only be used for that purpose and no other.

User shall be responsible and liable for any third party gaining access to the Online Booking System through the use of the User’s username and password,

User shall comply with the rules of any network through which User accesses the Services.

User shall comply with and shall not contravene the Applicable Laws, without limitation laws of such jurisdiction relating to the use of the Services.

 

The Services is only available in Malaysia. If for any reason User uses the Services outside Malaysia, Perinaga Cemerlang Sdn Bhd may not support the Services, and User’s use of the Services is at the User’s own risk including the risk that the use thereof violates local laws in the country/jurisdiction.

 

Placing an Order

a) Ordering Process: To place an order, you must follow the instructions on the ordering pages of the Website. You must provide all information required for the online order, including but not limited to, your full name, telephone number, email address, your choice of pick up store and pick up date. We reserve the right to request further information from you at any time to enable us to complete your order and/or to comply with regulatory requirements. By placing an order, you confirm that all information provided by you is correct in all respects.

b) Currencies: The Service is only available for the currencies listed from time to time on the ordering pages of the Website. These currencies are subject to change from time to time at our sole discretion.  The currencies available for pick up at off-airport stores may differ from those available for pick up at the Airport stores.

c) Denominations: You cannot select your preferred currency denominations on the Website. The amount of currency ordered will be rounded to the minimum banknotes denomination for the relevant currency as determined by us.

d) Minimum and Maximum Order limits: all online orders are subject to: 

    i) a minimum value of MYR300 (or the equivalent in other currencies) per order; and 
    ii) a maximum value of MYR3,000 (or the equivalent in other currencies) per order.

These order limits are subject to change from time to time at Perinaga Cemerlang's sole discretion. 

e) Small denomination notes: Selling small denomination notes for USD and SGD have different rates as listed below:

i) USD 1,5,10,20 have a lower rate than USD 50,100.

Ii) SGD 2,5,10 have lower rate than SGD 50,100, 1000.

Regardless of amount exchanged, use of smaller denominations will be calculated differently as stated above. For a mix of big and small denominations, we can only account up to 10 maximum number of smaller denomination notes with at least 1 big denomination note to be calculated with using the normal rate. We do not accept any foreign currency in the form of coins and for purchase of foreign currency with balance of coins shall be returned to the customer in the form of RM

.

f) We do not accept 1 dollar notes of SGD and/or USD as well as coins.

g) Collection Store: During the online reservation process, you must select a Perinaga Cemerlang Sdn Bhd store to collect your booked currency from.(“Collection Store”). Please note that once you have placed your order, you cannot change the nominated collection store.

h) Collection Date (Counter Pickup): Once you complete your booking, you must collect your order within 48 hours from time of confirmation. Otherwise, we exude the right to automatically terminate or cancel any uncollected order within the stipulated time as noted in your booking details and confirmation e-mail.

Please note that public holidays may affect the available Collection Dates. If a public holiday falls on a day between the Reservation Date and the proposed Collection Date, we may require an extra day to process your order. 

We will use our reasonable endeavor to meet your nominated Collection Date, but we will not be liable for failing to do so.  If you wish to change the nominated Collection Date, you may contact us at any time prior to the Collection Date. The new Collection Date must fall within the original Collection Period.  

 i) Confirmation: After you click on the ‘Reservation’ button, our system will display a confirmation page setting out the details of your reservation. This confirms our receipt of your reservation. We may, at our sole discretion, accept or reject any reservation received by us.  If your reservation has been accepted by us and we agree to provide the Service to you, you will receive an ‘Online Request Status Update (REFERENCE NO:_ )’ (“Confirmation Email”) from us. A contract between you and us is only formed when we send you the Confirmation Email that your order has been accepted. Please print a copy of the Confirmation Email and bring it to the Collection Store. 

j) Payments: In the case of self-collection, you are not required to pay for your order on the Website. Payment must be made on collection. For any transaction through “Online Banking”, you are required to complete your payment through our designated bank and update your booking details through the request history, and fill in the required information. Details that are required include the name of Bank, Bank Account Number, Transaction Reference Number, Transaction Amount and for you to Upload your online banking slip or proof.

k) Reservation Cancellation: You may cancel your reservation at any time prior to the nominated collection date by going to your Request History, clicking on the booking which you wish to cancel, click on “Cancel Transaction” and confirm. If you do not cancel your reservation prior to the collection date and fail to collect your order from the Collection Store on the nominated collection date, your order will be cancelled by us.

l) Reservation Amendment: You cannot amend your reservation after it has been submitted to us. However, you may cancel your existing reservation and place a new reservation on the Website.

Important notice for customers using net banking to fund our account. Please use your internet banking account to fund your transaction. Use your own account for funding the transaction. Note: We do not accept payments made through third party accounts via net banking. Using third party accounts will result in your transaction being not processed to protect you from fraud.

Exchange Rates

We are constantly updating our currency rates on the Service. The services available on our Service may be mispriced, described inaccurately, or unavailable, and we may experience delays in updating information on the Service and in our advertising on other web sites.

We cannot and do not guarantee the accuracy or completeness of any information, including currency rates, availability, and services. We reserve the right to change or update information and to correct errors, inaccuracies, or omissions at any time without prior notice.

The applicable foreign exchange rates vis-a-vis RM are based on the latest Rate Table provided by us and are subject to change without prior notice at our sole and absolute discretion.

The rates may be changed upon approval of booking upon the consent form the customer in circumstances which the rates has been wrongly approved of.

To the extent permitted by law, the exchange rate applicable to your actual purchase is either: 

i) the exchange rate set out in the Confirmation Email provided to you by us; or 

ii) the exchange rate displayed on the rate board or, if the exchange rate for a specific currency does not appear on the rate board, the exchange rate notified by our staff at the Collection Store at the time of collection. 

You acknowledge that the exchange rates available on the Website for online orders may differ from the exchange rates offered at the Collection Store. 

Collection of Booked Currency

a) Orders can be collected by you (the person who is named as the customer in the order) from the Collection Store set out in the Confirmation Email. Collection is subject to the opening times of the Collection Store. Details for the opening times of the Collection Store can be obtained on the Website. 

b) At the time of collection, you must produce the following to us: 

a. a print out, screenshot or copy of the Confirmation Email; and 

b. one of the following original identification documents (photocopies will not be accepted): 

i) NRIC, Driving license or Passport if you are a Malaysian National 

ii) Passport if you are a foreigner (This includes foreigners living in Malaysia under a resident pass)

c) If you are unable to produce the above items at the time of collection, we may not provide you with your booked currency and your reservation may be canceled by us. For the avoidance of doubt, we will not release the booked currency to you if you do not produce the identification document specified in sub-clause b) above. 

d) In order to comply with our anti-money laundering and other legal/regulatory obligations and our internal risk and fraud policies, we may request you to provide further information and identification documents (such as proof of residential address) and take a copy of your identification documents and other documents at the time of collection.

e) You must pay for the order in full before we release the booked currency to you at the Collection Store. Payment must be made 

Online Banking

Transaction through our Online Banking system requires the customer to be physically present at the Collection Store for purpose of Identity Verification. We reserve the right to reject and/or cancel the transaction if we find that the person registered under the Identity Card or other credentials given is not the same individual. This is to protect our customers from cases of Identity Theft and/or Fraud.

a) At the time of verification, you must produce the following to us: 

i) a print out/screenshot of the Confirmation Email; and 

Ii) one of the following original identification documents (photocopies will not be accepted): 

◦ NRIC or Passport if you are a Malaysian National or Singapore National

◦ Passport if you are a foreigner (This includes foreigners living in Malaysia under a resident pass)

Content

Our Service allows you to post, link, store, share and otherwise make available certain information, text, graphics, videos, or other material ("Content"). You are responsible for the Content that you post to the Service, including its legality, reliability and appropriateness.

 

Links To Other Web Sites

Our Service may contain links to third-party web sites or services that are not owned or controlled by us. We have no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party web sites or services. You further acknowledge and agree that we shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services.

 

Limitation of Liability

In no event shall we or our affiliates be liable to you or any third party for any special, punitive, incidental, indirect or consequential damages of any kind, or any damages whatsoever, including, without limitation, those resulting from loss of use, data or profits, whether or not we have been advised of the possibility of such damages, and on any theory of liability, arising out of or in connection with the use of this site or of any web site referenced or linked to from this site.

Further, we shall not be liable in any way for third party goods and services offered through this site or for assistance in conducting commercial transactions through this site, including without limitation the processing of orders.

Some jurisdictions prohibit the exclusion or limitation of liability for consequential or incidental damages, so the above limitations may not apply to you.

 

Indemnification

Upon a request by us, you agree to defend, indemnify, and hold us and our Affiliates harmless from all liabilities, claims, and expenses, including attorney's fees, that arise from your use or misuse of this site. We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will cooperate with us in asserting any available defenses.

 

Security and Password

You are solely responsible for maintaining the confidentiality of your password and account and for any and all statements made and acts or omissions that occur through the use of your password and account. Therefore, you must take steps to ensure that others do not gain access to your password and account. Our personnel will never ask you for your password. You may not transfer or share your account with anyone, and we reserve the right to immediately terminate your account if you do transfer or share your account.

Password Reset

In the case that you forgot your password, contact us via E-mail or fill in our “Contact Us” page to inform us of the issue. Please note that we need to verify your identity before resetting your password and may ask for a copy of your NRIC or Passport or any identification method that you have used upon registration. Upon verification, we will reset your password and provide you with your new password via E-mail or phone which you can use to log-in and head to your profile and reset your password to a new one.

 

Termination

We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

 

Governing Law

This site (excluding any linked sites) is controlled by us from our offices in Singapore. It can be accessed from the country, as well as from other countries around the world. As each of these places has laws that may differ from those of Singapore, by accessing this site both of us agree that the statutes and laws of the State of Singapore, without regard to the conflicts of laws principles thereof, will apply to all matters relating to the use of this site and the purchase of products and services available through this site. Each of us agrees and hereby submits to the exclusive personal jurisdiction and venue any court of competent jurisdiction within the State of Singapore with respect to such matters.

Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 7 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
